my father is a retired bank manager (retired in may-2009) and just before 4 months of his retirement the amount 80,000/- has been mis appropriated. Please find the following steps for case disbursement in banks : The manager will check the customer balance and initiate the fund disbursal in the computer by checking his withdrawl form. The cashier has to verify the withdrawl form signed by my the manager and chechk the balance in the account and also the iniated withdrawl by the manager and then disburse the amount to the customer. in Jan-2009 around 80,000/- has been disbursed to the customer in addition to his withdrawl amount. This period is initial days of bank computerization. The 80,000/- more amount initiation was done by my father in the computer as per records. My father is claiming that the days were inital days of computerization and his password was known to the cashier as well. Vouchers also will be there to support the computer but vouchers are missing now.This incident has been identified by the bank in 2013 and a case has been filed against my father (A1) and the chahier (A2) in 2013. now my father is in asticipatory bail. we have the following questions. 1) There will be regular audits for every 1.5 years in the bank and total 2 audits performed and thie case was not identified then? 2) Usually the vouchers should be there and I think none of the vouchers are available. 3) The customer initially said that he did not get more money from the bank and hence the bank approached court and filed the case but just before the case was filed, again the customer payed the additional money to the bank saying that he took more money by mistak. but by this time, the case was already filed in the court. Now the account is clear. we suspect the cashier on this event as he was there in the bank after my fathers retirement for some time and the vouchers would have been disappeared becasue of him. 4) During this entire time, till the case is filed, not even a single notice has been sent to my father. 5) What is the complexity of this case by considering all the above points as the account is already clear now that except the bank computer initiation none of the supporting documents were existing. It is the cashier who has to finally verify the available amount and the signature of my father and then disburse the amount. Even if wrognly posted in the computer, he can reject and request for correct amount. Also initially customer said he did not take the money and fianlly he payed the money back to the bank by saying that he took more money just before the case filed. Hence we strongly suspect that the cashier is involved in this since he is aware of the password and he made the payment through the customer to the bank when he heared the case is going to the court. Our lawyer saying this as small case and will be stricken off since the bank received the amount. But what is the procedure to expedite the case since for last 5 years we are passing through the mental struggle.. Their pension also announced now. Does my father get the pension and arrears on par with other employees since the case is still in the court and he is not convicted.....
