My friend having a pharma manufacturing plant in himachal. According to law a drugs inspector can pick sample from finished product stock only from a pharma manufacturing plant. But while visiting the plant he pick the sample from production area rejected stock . Product was under production and not checked and passed by quality assurance . Now drugs inspector planning for prosecution on my friend . What step should be taken legally to stop the prosecution.

You may immediately approach High Court and get a stay on the notice or FIR or private complaint issued/filed by Drug Inspector.
