Q:

My grandfather had purchased a site to build a house and then transferred it to his elder son's name as it was convenient to get a loan to build a house. The elder son then claimed the property as his own and the second son ie my father did not get any share. Is this legal? Can this not be challenged legally as my father did not get any share in his father's property [ie site]. Can my grandfather transfer the site to just one son's name even though they did not care for my grandparents in their old age.

A:

Dear Sir,

Your father may file a suit for partition and establish that it belongs to your grandfather and entitle for share.
